469. tolérance zéro pour l'intolérance
Le débat est ancien, inépuisable et je ne vais faire que jeter de l'huile sur le feu, je sais tout ça. Mais je viens de lire un article du (souvent) conservateur mais (le plus souvent) intelligent Times de Londres. Un article qui explique qu'en Grande Bretagne, on est tout prêt de voter la future loi sur l'interdiction de tout propos haineux contre différentes formes de genre ou d'orientation sexuelle. Le contrevenant sera passible d'amendes et de prison (avec un maximum de 7 ans). Sont concernés, pour ce qui est du genre, de la haine contre les transgenres (et les transexuels), et pour ce qui est de l'orientation, de la haine contre les homo et les bisexuels, mais aussi les hétéro.
J'insiste sur les termes "genre" et "orientation", puisque l'avis actuel des experts consiste à dire qu'il s'agit de deux éléments de la sexualité qui sont "reçus" et non réformables (avec une nuance pour les transgenres). À la différence des préférences et de l'identité sexuelles qui proviennent, elles, de l'histoire, du vécu, de la culture, des choix, etc. et qui pourraient évoluer avec le temps. Dès lors, comme pour le racisme ou le sexisme, la loi va déclarer qu'il est inacceptable, dans une société démocratique, de s'en prendre (verbalement ou physiquement) à des personnes à cause de ce qu'elles sont. Comme disait le ministre britannique de l'intérieur, "quel chemin parcouru en dix ans, mais il est temps d'affirmer qu'une démocratie ne peut tolérer de propos haineux basés sur la sexualité de quelqu'un".
Jusque là, tout va bien.
Le hic vient de plusieurs mouvements religieux, et en partie de la Hiérarchie Catholique (bien que les plus bruyants sur cette question soient les Chrétiens Évangéliques). L'argument est tout simple: "nous contestons que l'orientation sexuelle existe et nous affirmons qu'il ne s'agit que d'une tentation ou d'un choix humain". Un choix plus ou moins grand, mais un choix tout de même. L'homosexualité, c'est comme la kleptomanie (pour reprendre l'avis du Patriarche de Moscou) ou comme l'adultère, le viol ou la masturbation (comme dit le catéchisme catholique). C'est mauvais, ce sera toujours mauvais, et ceux qui le font doivent être avertis haut et fort que c'est mauvais. S'ils sont croyants, il faut donc en outre leur rappeler que c'est un péché, en l'occurence du genre "très grave".
Ce qui étonne, c'est que cette ignorance des religieux pour les découvertes de la psychiatrie, de la psychologie et de la biologie devraient, selon leur dire, être protégée par la loi. Ils récusent cette loi contre les propos haineux au nom de la liberté de l'expression religieuse. Pour prendre un comparaison, les croyants devraient-ils avoir le droit de dire que les femmes sont inférieures aux hommes et que celles qui le refusent sont des "mauvaises" et des "pécheresses"? Autre exemple, les autorités religieuses devraient-elles avoir le droit de dire que les gauchers sont "maudits par Dieu" et qu'ils doivent se réformer pour redevenir droitiers comme c'est prévu depuis la Création?
Et là, comme pour me couper l'herbe sous le pied, le Times ajoute un autre article à celui que je vous cite: Zero Tolerance for Religious Intolerance. En d'autres termes, les religions se sont trompées sur un tas de sujet dans le passé. Elles le feront encore, y compris la religion chrétienne et (n'en déplaise à qui vous savez) le Catholicisme. Il est arrivé, il arrive et il arrivera que les religions fassent du tort et fassent mal, même en ayant le désir de suivre leurs sublimes principes. Je pense que ce n'est pas anti-religieux et en particulier anti-catholique de le dire. Même Jean-Paul II, en demandant pardon pour les fautes commises au nom de l'Église, n'a pas exclu qu'il y en aurait d'autres dans l'avenir ou bien qu'on en découvrirait d'autres dans le passé. Mais c'est sans doute un héritage du précédent pape que l'on tente actuellement d'occulter. Pour ma part, j'ai confiance que cette "reprise en main" n'est en fait qu'un "dernier sursaut de mourant" et que l'homophobie officielle de l'Église ne fasse l'objet d'une demande de pardon d'un prochain pontife.
Dès lors, je crois que les hiérarques et les autorités de toutes les confessions présentes dans nos démocraties doivent s'attendre à êtres mis en question et en procès pour leurs propos haineux, y compris contre les minorités sexuelles. Mais il y a des procès qu'elles gagneront, et d'autres qu'elles perdront. Et si quelqu'un les accuse d'homophobie mais qu'un tribunal leur donne droit, où est le mal? Après tout, gagner un procès est meilleur que d'être exempt de poursuites. Pour donner un exemple, je suis curieux de voir ce que va donner en Belgique le prochain procès contre la Scientologie.
Pour les mêmes raisons, les religieux se donnent aujourd'hui le droit d'aller en justice quand leurs convictions sont calomniées ou ridiculisées. Qu'ils acceptent la contrepartie: la possibilité d'être mis en cause dans le tort qu'ils font aux autres. Et si leur religion fait du mal aux gens, en particulier aux minorités sexuelles, il faut que cela cesse. Qu'il s'agisse d'une petite secte ou d'une grande "foi" présente à l'échelle mondiale n'y change rien.

Je trouve sela affreux qu'il existe encore des homophobes dans des pays soit-disamment développés. Surtout lorsqu'il s'agit de croyants. Le Christ est formel : nous serons jugés de la même façon dont nous avons jugé. Je sais que le Pape Benoit XVI est contre les homosexuels. Je trouve cela stupide. Ils ne devrait pas juger. Les homosexuels n'ont normalement pas le droit d'entrer dans un ordre monastique car (selon certains) il y aurait trop de tentations. Et le prêtre qui fait la messe aux moniales cloîtrées et qui les confesse, il ne ressent pas de tentation lui? On dirait que ça ne marche que dans un sens. Récemment on m'a déclaré que les homosexuels sont comme des drogués! Je n'ai jamais entendu quelque chose d'aussi stupide! Comme si on avait le choix! Je suis lesbienne et catholique et ce genre de propos me font mal. Je me sens appelée à la vie monastique cloîtrée chez les moniales chartreuses et je suis bien triste de penser que je ne pourrais peut-être pas rejoindre cet ordre à cause de mon attirance pour les filles. Pourquoi le Seigneur m'appellerait-Il si je ne n'ai pas le droit d'aller à l'endroit qu'Il me montre? La hiérarchie éclésiastique ne s'est jamais posé la question?
